The website contains information and material relating to the Bombay International School (“BIS”), including the IB Diploma Programme offered by the school. The IB Diploma Programme of the school is administered by the Education Initiative Trust (“EIT”). BISA and EIT are societies registered under the Societies Registration Act, 1860 and public trusts registered under the Bombay Public Trusts Act, 1950, having their registered office at Gilbert Building, Babulnath 2nd Cross Road, Mumbai – 400 007. The term “BIS” should be read in this document as a reference to BISA and/or EIT as the case may be and/or as the context may require. The terms “BISA” and “EIT” should be read as meaning and including their trustees, Board of Governors, officers and employees.

With respect to the above, BIS (including its trustees and/or Board of Governors and/or employees and/or affiliates and/or agents and/or representatives and/or officers) shall not be liable for any loss and/or liability resulting, directly and/or indirectly, from this Agreement, delays or interruptions due to electronic or mechanical equipment failures, congestion, telephone interconnect problems, defects and for reasons of force majeure, which are out of BIS’ control, as may include but is not limited to weather conditions, earthquakes, floods, fire, other acts of God, and/or incidents of strike, lockout, walkouts, riots, armed conflicts, acts of war, acts of government, explosion, accident, civil commotion, riot, industrial dispute, bandh(s) instituted by any person including a political party, or other like causes. BIS shall have no responsibility to provide the User with access to the Website while such interruption is ongoing.

BIS shall, in no circumstances whatsoever, be liable for any direct and/or indirect and /or punitive and/or incidental and/or special and/or consequential damages and/or damages of whatsoever nature including but not limited to damages for loss of use, data or profits, goodwill and/or other intangible losses arising out of or in any manner connected with the use or performance of the website or its content, with the delay or inability to access or use the website or related services, the provision of or failure to provide services and/or any particular Item, or for any content, software and services made available or obtained through the Website or its content or otherwise arising out of the use or access of the Website or use of the services, whether based on contract, tort, negligence, strict liability or otherwise, even if BIS has been advised of the possibility of damages. By using this Website, the User is deemed to agree to defend, indemnify and hold harmless BISA, its employees, directors, officers, agents and their successors and assigns from and against any and all claims, liabilities, damages, losses, costs and expenses, including attorney’s fees, caused by or arising out of claims based upon your actions or inactions, which may result in any loss or liability to BIS, including but not limited to breach of any warranties, representations or undertakings or in relation to the non-fulfillment of any of your obligations under this Agreement or arising out of your violation of any applicable laws, regulations including but not limited to intellectual property laws / rights, claim of libel, defamation, violation of rights of privacy or publicity and infringement of any intellectual property or other rights.

Should the User at any time be dissatisfied with the services provided on the Website, its contents and/or the terms of use and/or this Agreement, as amended and/or modified from time to time, the only recourse available to him/her/it would be to discontinue the use of the Website.

BIS reserves the right to terminate any registration and/or refuse access to the Website and take such other action (including recourse to legal remedies) as advised, if it has reason to believe that a User has breached any of the terms and conditions as forming a part of the Agreement and/or for any reason whatsoever.
